| 摘 要： | 20世纪90年代以来，因对传统的回归、现实国家法神化的破灭及法律多元化认识的影响等原因，法学界非常关注国家法之外的民间法的研究。文章试结合各种观点明确民间法的定义与特点及其存在的价值。

| Abstract: | Since the 1990s,because of returning to the tradition,being disillusioned with the deification of the realistic state law and being influenced by the understanding of legal multiplication and so on,,the legal fields pay attention to research the folk principle which are outside the state law.The article tries to unify each viewpoint to be clear about the definition and the characteristic and the value of the folk principle. |
