论司法权威的生长

司法权具有多义性,从广义上可分为审判权和检察权,而司法权威是司法机关应享有的威信和公信力。司法权和司法权威密不可分,司法权威的失范是对其本质与价值的背离。司法权威失范的重要原因是失范司法权的攻击性、混沌性、非终结性、非及时性。我们必须对司法权威的失范进行矫正,寻求规制司法权威失范的“阿基米德基点”,回复司法权的正义品格,使司法权威成为民众的信仰,实现司法权威的生长。
