我国近代刑法移植研究

富民强国的国家目标使得近代以来的刑法移植从一开始就具备功利的价值追求。这种功利性的价值追求使得刑法移植常常表现出分裂的性格,即内容和形式的分裂。从内容看,移植的刑法资源与中国的传统刑法文化不相适应,阻碍了刑法的司法适用;从形式看,移植的刑法又与中国传统刑法有非常高的相似性。刑法移植过程中出现这种分裂性现象不仅不可避免,而且恰恰是我国刑法近代转型中所必须正视的问题。

Research on Chinas Criminal Law Transplant in Modern Times

The national object to make the country rich and people strong has caused the modern criminal law transplant to have the pursuit of utility value from the very beginning.This kind of pursuit makes criminal law transplant often display fission of characters,i.e.the fission of its contents afd form.Seeing from the contents,the criminal law resources of transplant is not suitable for Chinese traditional culture of criminal law and has hindered its judicial application;seeing from the form,the transplanted criminal law has many similarities with Chinese traditional criminal law.The fission phenomenon is inevitable during the transplant,and moreover,it is exactly a problem needed to be faced up to in the reforming of China's criminal law transplant in modern times.
