文化遗产权利的公益透视

对于公共利益的探讨成了时下学界关注的热点问题,但鲜有学者研究文化遗产权。试用热点问题的内容来讨论冷门话题,首先,对文化遗产及文化遗产权作了一大致介绍;其次,梳理了一下与文化遗产权有关的公共利益理论,并用现有的公益理论、从公共利益层面来解析文化遗产权,探讨其公权属性;最后,简单谈了一下公益冲突理论对于文化遗产权保护的启示。

Culture and Heritage Rights: from the Perspectives of Public Interests

Explorations on public interests have become a hot topic recently in academia, but few scholars have touched the culture and heritage rights yet. This article, using the contents of hot topics to discuss ones which receive little attention, first of all, introduces briefly the cultural heritages and rights of culture and heritage, then organizes the theories of public interests related to culture and heritage rights. And with existent theories of public interests, this article explains what culture and heritage rights are, from the perspectives of public interests, explores their attribute of public interests, and finally draws inspiration from conflict theory of public interests on the protection of culture and heritage rights.
