物权行为理论的存废问题初探

自萨维尼提出物权行为理论以来,在世界各国就引起了较大争论,特别是在其存废问题上一直有肯定说和否定说两种观点。物权行为在概念、效力、特征和价值等诸多方面均与法律行为不符,同时建立物权行为理论所要达到保护交易安全的目的也不能通过该理论而有效地实现。与其对物权行为理论修补,不如顺应法律发展的潮流,舍弃这一理论。

The Real Right Behavior Theory, Living or Dying

The real right behavior theory has been causing argument in the various countries of the world since it is established by Saiweni,about whether it should be living or dying,there is two viewpoints.The real right behavior is many different aspects,including the concept,the potency,the characteristic and the value and so on,with the legal act symbol,it should be essentially one kind of fact behavior,simultaneously it is not able to realize the protection of transaction security through establishing the real right behavior theory.We should discard this theory complying with the legal development current but not patch the real right behavior theory.
