电子商务侵权法基本问题研究

电子商务侵权行为和电子商务侵权法是我国电子商务立法中需要解决的关键问题。电子商务侵权行为不完全等同于网络侵权,其在侵害主体、侵权行为地、侵害客体等方面都有新的特点,如侵权主体多样化、低龄化,侵权客体多层次,侵权行为地之间空间距离较远等,因此,在侵权法立法上应对电子商务予以充分重视,并与国际接轨。

A Study on the Basic Problems of Law of E-commerce Tort

E-commerce tort act and E-commerce tort law are the key issues in E-commerce law legislation in China. E-commerce tort act is not completely identical to network tort act, which has its new characteristics in the aspects of body of tort, place of a tortuous act and body of damages. Therefore, law of E-commerce tort merits further investigation.
