| 摘 要： | 对于扰乱市场秩序犯罪的客体,应当以经济利益和公共利益为内在标尺、以"市场领域"和"政府领域"为外在标尺,在市场秩序与国家管理秩序之间划出一道清晰的界线。明晰这一界线,理论意义在于发掘具体罪名的价值取向、确定具体罪名的犯罪客体,现实价值则在于准确把握具体罪名的本质内涵,对有争议的问题给予坚定的回答。

| Abstract: | As for the object of the crime of disturbing market order,we should distinguish market order from state administration order with economic interests and public interests as the internal standard,and with"market"and"government"as external yardstick.The theoretical significance of clearing this boundary lies in the excavating the value orientation of specific charges,and its realistic value lies in accurately grasping the essence of specific charges and giving positive answers to controversial issues. |
