| 摘 要： | 中国《宪法》规定批准逮捕权是法律监督权的组成部分，审查批准逮捕权由检察机关行使是由检察机关的法律监督性质决定的，在批准逮捕权的行使过程中还存在一些问题，通过完善相关制度、制定相关措施来解决这些问题。
