| 摘 要： | 视频网站是否对相关视频负有监督审查义务,以及如何才能在版权纠纷中得到安全港的保护是认定其是否构成间接侵权的关键。《集结号》案表明只有尽到合理注意义务,善意、谨慎的视频网站才能获得安全港的保护,免除间接侵权责任。

| Abstract: | Whether video-sharing website has the duty to supervise the videos on it,and how to get the protection of safe harbor provisions are the key to establish their indirect copyright infringement responsibility.The case of The Assembly demonstrates that only the goodwill video-sharing website who did the reasonable attention duty can get the protection of safe harbor provisions,and relieve from indirect copyright infringement responsibility. |
