| 摘 要： | 对世界贸易组织规则(以下简称WTO规则)的研究很多,但对国际私法与WTO规则关系比较的研究,则尚属缺门,而且,还出现了世贸组织成立之后,国际私法的作用削弱了的意见;但实际上国际私法的作用反而更大了.本文论述国际私法与WTO规则的联系与区别、效力比较、WTO规则能否在法院直接适用、国际私法在WTO规则促进下的新发展,并提出尽快完善我国国际私法立法,更好地实施WTO规则.

| Abstract: | A lot of studies have been made on WTO rules, but there has been few comparative study on the relationship between private international law and WTO rules. Besides, some people think that the function of private international law is weakening after the foundation of WTO. In the authors' opinion, however, the function is strengthening. The article discusses the connection and the difference between private international law and WTO rules and makes a comparison between their respective effects. The article also discusses whether WTO rules can be applied directly in domestic courts and the new development of private international law under the promotion of WTO rules. The article suggests perfecting private international law of the People's Republic of China in order to enforce WTO rules better. |
