对中国“检察一体化改革”的思考

检察一体化改革所要解决的问题是克服检察地方化,按照检察制度的内在规律合理建构检察权,这是与我国的基本政体形式相一致的.但是,定义良好的检察一体化改革是有条件的.审视我们现在对检察一体化改革的议论,主张权力的多,谈限制权力的少;谈确立权力的多,谈权力行使的正当程序和机制的少.而在这些条件被清楚地厘定之前,要推行和建立检察一体化改革必然是困难的,也缺乏应有的正当性.

Reflection on the "Reform of Procuratorial Integration" of China

The purpose of the reform of procuratorial integration is to overcome the localization, reasonably construct the procuratorial power in accordance with the interior rule of the procuratorial system, which conforms to the fundamental polity of China. However, well defined procuratorial integration reform depends on several conditions. Most of the arguments concerning the procuratorial integration reform claim the power and its establishment while few discuss the restriction of the power and the due process and mechanism of the power exertion. It will be difficult and unwarrantable to advance the reform before the conditions are clarified.
