当代媒体权与司法权之关系新 论简

近年来,媒体权力对司法权的监督力度不断加大,因此使得媒体监督权与司法权之间的关系日趋紧张。新闻媒体的介入虽然在一定程度上能避免司法不公的出现,但是其对舆论的引导以及对司法活动的干预现象也是不容忽视的。基于此,我们应该抱着积极的态度去化解两者之间的冲突,并找到两者之间的平衡点,从而使媒体监督为司法活动的公正进行保驾护航。

New Discussion on the Relationship between Present Media Rights and Judicial Power

In recent years,media supervision over judicial power has intensified ,which makes the relationship be-tween the media supervision and judicial power increasingly tense .Although the media involvement can avoid mis-carriages of justice to a certain extent ,its guidance of public opinion and intervention in judicial activity cannot be ignored.Therefore,we should resolve conflicts between them with a positive attitude and find a balance between them so as to make media supervision guarantee impartial judicial activities .
