A Staged Analysis of Police Power of Administrative Penalty in China

Taking Law on Public Security Administration Punishment as a sample, we divide police power of administrative penalty into three stages, that is, investigation power, decision power and enforcement power. Police power of administrative penalty in China has the characteristics of fuzziness and ambiguity if we analyze from the perspective of constitutional theory. Therefore, seeking clearness from ambiguity is the way to control and regulate police power of administrative penalty in China.
