经济全球化与物权法的国际化

物权法中有关固有法的内容是难以国际化的,包括关于所有权类型的物权规范、关于用益物权类型的物权规范、与各国的习惯及现实经济生活密切联系的物权规范。但是,有关交易的规则是可以国际化的,如关于交易的规则、有关担保的规则和有关公示方法、效力等方面的规定。物权法的国际化还表现在必须充分注重物权法的发展趋势,并很好地把握这一发展趋势。

Economic Globalization and Internationalization of the Real Law

It is difficult to internationalize the indigenous law content in the real law including the provisions regarding the proprietary rights,usufructuary right and provisions close related to the custom and present economic order of a country. However,the regulations concerning the business such as rules of trade,guaranty,publicity and validity may be internationalized.Recognition and application of global trend of the development of the real law is also an aspect of the internationalization of the real law.
