| 摘 要： | 《宪法》、《老年法》及多种相关法律法规,充分肯定了以老年人合法权益为核心的老年人法律地位。应充分保障老年人法律地位。目前,社会上时隐时现的所谓老年人"累赘"、"包袱"论、"离退休人员是靠在职人员养活"论等言论有损老年人法律地位,不符合事实与情理。

| Abstract: | While ascertaining the conception of the legal status of senior citizens in contemporary China, based on the characteristics the senior citizens and constitution and Law of the PRC on the Protection of Rights and Interests of the Aged, the present study afrom the legal perspective pproves of the content of the legal status of senior citizens which is embodied from 15 aspects. The features and the theoretical basis of senior citizens＇ legal status has been clarified. Moreover, some fallacies are criticised, such as the idea that regards the aged as encumbrance, and the opinion that believes the retired are supported by those who are in active service. Finally, some sugesstions are put forward in the paper. |
