| 摘 要： | 惩罚性违约金的界定标准应当采＂责任并行说＂。惩罚性违约金的惩罚性在于其适用不会影响其他违约责任。与＂损失比较说＂相比,＂责任并行说＂更有助于实现惩罚性违约金的功能并明晰惩罚性违约金的界定。采＂任一标准说＂不仅在逻辑上有错误更会带来实践中的混乱。

| Abstract: | The define standard of punitive liquidated damages should adoptethe theory of responsibility in parallel.Thepunitive of punitive liquidated damages lies on its application does not affect other breach of contract.Compared tothe theory ofloss compare,the theory of responsibility in parallelis more conducive to achieving the functions of punitive liquidateddamages and it can make more clear definition of punitive liquidated damages too.Adopt the theory of either throrynot onlywrong in logic but also will bring confusion in practice. |
