| 摘 要： | 我国侦查羁押制度存在着羁押期限过长、延长羁押期限理由含糊不清、相关规定互相矛盾、审批程序行政化、羁押场所非独立性等问题。完善侦查羁押制度的路径是：适当缩减侦查羁押的一般期限，明确规定逮捕后的最长羁押期限，明确延长羁押期限的理由，修改延长羁押期限的决定权，规定在退回补充侦查阶段不能延长侦查羁押期限，明确规定重新计算羁押期限的法定情形和批准机关，实行羁押审批程序的诉讼化改造，建立羁押复查制度，实行羁押场所和办案机关分离制度，建立羁押场所独立巡视制度。
