论构成要件与刑事政策的关系

刑法学是最为精确的法学。而这样的精确不仅仅是教义学的缜密的逻辑推导，还应在建构逻辑推导之前就以合理地组织对犯罪的反应作为价值基础奠基这样的逻辑大厦。这样的刑法学是教义学与刑事政策学融合的成果，能够成为这样的最为精确的学科。“合理组织对犯罪的反应”翻译到教义学语言中就是犯罪论的“有效益犯罪论体系”、刑罚论的“例外规律——量刑反制定罪”以及行刑论的“刑事和解对教义学的价值回归”这样的一系列重大范畴。构成要件作为犯罪论体系最为基础的阶层，对于犯罪成立的定型、区分、个别化、推定等诸多功能，使得追求有效益犯罪论体系的理论建构，又必须以之为入口（本文以刑事政策的视角观察构成要件的理论沿革。进而介绍罗克辛教授以刑事政策为导向进行建构引导的构成要件理论变革。最后对刑事政策在我国刑法教义学建构的结构和解构的范式进行了初步探索）。

On the Relationship between Theoretical Constitutions and Criminal Policy

The science of careful logical deduction criminal law is the most accurate legal science. And such precision is not only the dogmatics, but also the reasonable organization for the reaction of crime as a value foundation based such logic building. Such criminal law is the combination of dogmatics and criminal policy theory, which constitutes the most exact subject. ＂Reasonable organization for the reaction of crime＂ in dogmat- ics language is a series of important category such as the theory of crime ＂benefit crime theory system＂, the theory of punishment ＂exception rule-sentencing counterspell condemnation＂ and the theory of execution ＂criminal reconciliation of dogmatics value regression＂. Constitutive requirements, the most basic ceass in the crime theory system, with regarol to the functions to finalize, distinguish, individualize, must be the entrance of the theoretical construction of the criminal theory system. This paper takes the criminal policy perspective to observe constitutive requirements theory evolution, and introduces Professor Luo Kexin Who tood criminal poli- cy as the guide to theory of the constructive elements. Finally it discusses the criminal policy in China＇ s crimi- nal law dogmatics construction structure and deconstruction of the model.
