论我国在押人员死亡调查制度之完善

在现行制度下，在押人员死亡后，没有一个独立于监管部门的外部机构进行独立调查，也没有社会力量能参与到整个调查过程中，相关部门给出的调查结论往往面临很多质疑。长此以往，国家权力的公信力将受到严峻挑战。为此，应借鉴英国经验，深化改革，以立法明确在押人员死亡的调查由检察机关主导，社会力量参与；同时，通过举行公开听证、公布调查报告等，满足社会公众的知情权，确保调查程序的正当性。

The Perfection of Our Country's Investigation System of Prisoner's Death

When a prisoner dies today, there is no independent investigation of independent department, and no social force can take part in the investigation. The investigation conclusions are always confronted with much suspicion. If the conditions continue, the public confidence of state power will be severely chal- lenged. Hence, we should use British experience for reference, deepen the reformation, and regulate that the People＇s Procuratorates decide the investigation conclusion and the social force participate in the process of investigation. Meanwhile, we should guarantee the justness of investigation procedure through hearing of witnesses and publicizing the investigation conclusion.
