| 摘 要： | 医疗事故罪是1997年刑法新增的罪名，从近几年的司法实践来看，对医疗事故罪的构成条件、罪与非罪的界限及该罪的刑事责任问题争议颇多。文章结合1997年刑法的规定及国务院2003年颁布的医疗事故处理条例（以下简称条例）的相关规定，阐述了对医疗事故罪的认定及医疗事故罪的刑事责任，以期对指导司法实践，有所裨益。

| Abstract: | The medical accident crime is a new charge which is added in the new criminal law in 1997.Looking from the judicial practice in recent years,there are many disputes about the medical accident crime's constitution condition,boundary between crime and non-crime and this crime's legal responsibility.Combining the stipulation of the new criminal law and the related stipulation of "The Medical Accident Processed Rule" issued by the State Council in 2003,this article discusses shallowly some views to each aspect question of the medical accident crime,which hopes to be helpful to judicial practice. |
