多位思索与深度检视:社区矫正制度研究综述——以2003-2010年CNKI期刊数据库的相关文献为素材

社区矫正是在20世纪70年代兴起于欧美国家的一种非监禁刑,我国于2003年开始此项制度的试点。作为对实践的回应,我国理论界从理论基础、主体、适用范围、意义、模式、实践效果、问题、对策与域外实践等诸多角度对社区矫正展开了思考与探讨,部分学者所谈及的社区矫正的不可行性研究、未成年罪犯的社区矫正、社区矫正的社会参与等具有进一步探究的价值。

Multi-perspective Thought and Deep View：Research on Community Correction System --Based on the 2003-2010 Years＇ Data from CNKI Journal Database

Community Correction rose in Europe and the United States as a non-custodial sentence in the 1970s, our country started the pilot of this system in 2003. As a response to the practice, China theorists think and discuss the community correction from various angles,from the theoretical basis, subject, scope, meaning, pattern, practice effects, problems, strategies to practice, and many other extra-territorial point of view. The infeasibility study for community correction, community correction of juvenile offenders, social participation of community correction that some scholars are discussing, are valuable for further research.
