| 摘 要： | 任何法律制度的建立和运行都需要相应的运作环境。民事诉讼模式环境是民事诉讼自认制度建立与完善的出发点和归宿点，我国民事诉讼自认制度的诉讼模式环境应选择当事人主义的诉讼模式。我国的民亨诉讼自认制度应从构成要件、自认的效力、自认的撤销与追复、对恶意自认的制裁等方面予以完善。
