论依法治校与高校法人地位

自1986年《民法通则》确立法人制度以来,高校在民法上的法人地位逐渐得到确认。随着1995年《教育法》和1998年《高等教育法》的颁布,使高校的法人地位有了新的法律依据。高校与政府之间的关系是一种由法律调整的行政法律关系。高校与社会的关系也随着社会法制化进程而形成错综复杂的民事法律关系。行政法律关系和民事法律关系的形成,意味着高校在民事活动中依法享有民事权利,依法承担民事责任。因此,作为独立法人的高等学校的治理结构必然是、也必须是法制化。
