农村不动产物权登记制度探析——以统一登记制度的建立为背景

我国目前农村不动产物权的登记制度存在很多问题,但这些问题并不仅仅是没有统一的不动产登记制度造成的;农村地区熟人社会的生活生产特点以及我国在农村实行的各种制度使得不动产物权变动过程中登记的公示公信、确权和对抗的目的成为不必要。因此在农村地区不动产市场建立起来之前,我们应该完善村民自治制度和行政管理性登记制度,而不是盲目追求登记的统一。

An Exploration on the Real Estate Registration System in Rural Areas

There are many problems in our country＇s current real estate registration system in rural areas, which not only resulted from the lack of unified registration system. The characteristics of living and production of acquaintance society as well as various systems in rural areas make public notice, right verification unnecessary in the change of real estate property. Therefore, we should improve the farmer autonomy system and administrative managerial registration system in rural areas before the establishment of real estate market rather to blindly seek the unification of registration.
