量刑程序独立化改革论纲

量刑规范化改革,改变了以往＂重定罪,轻量刑＂的不合理做法,但这不一定就说明相对独立的量刑程序就是量刑程序改革的终点。从长远来看,构建独立的量刑程序才能更有效地实现量刑的公正性、合理性。在这一过程中,被告人的量刑程序选择权、被害人的量刑参与权、检察机关的量刑建议权以及量刑辩护问题都是值得深入探讨的重要问题。

The way that heavy conviction and light sentencing has been changed as the reform of sentence standardization.While it cannot show that independence sentence procedure is the end of reform.In the long term,the independence sentence procedure can realize the fairness and rationality of sentence.During this proceeding,the accused part's rights of choice,victim's rights of participant,procuratorate organs' rights of suggestion,and the defendant in sentence procedure should be discussed deeply.
