| 摘 要： | 宪政是法治的高级形式。宪政是以宪法为前提,民主是宪政的基础,法治是宪政的载体,人权是宪政的目的。宪政包含民主、法治和人权三个基本要素,宪政民主就是以宪政主义为根本的民主制度,宪政决定法治,宪政和法治必须是以良法为前提,良法之关键在于宪法的至上性。
