刑事被害人保障制度之构建

关于刑事被告人人权的保障问题,已被理论界和司法实务界长期关注,但关于刑事被害人的人权保障问题,却没有给予足够的关注和重视。随着社会的发展和人权保护的日臻完善,刑事诉讼中被害人的人权保障问题必须给予高度的关注和重视。文章通过对刑事被害人人权保障的缺失及缺失的成因分析着手,提出了构建我国的刑事被害人人权保障制度。

Building a System to Safeguard the Human Rights of Victims in Criminal Cases

Theoretical and judicial circles have long been concerned about the issue of safeguarding the human rights of defendants in criminal cases, but up till now no enough attention has been paid to the issue of safeguarding the human rights of the victims. With social development and a lasting improvement on human rights protection, great attention should be paid to this issue. This article points out the lack of rules in our law to protect the human rights of victims in criminal cases, analyses contributive factors and comes up with the suggestion of building a system to safeguard their human rights.
