婚生子女可随“第三姓”立场之反思

在选定姓氏时，父母原则上不应该享有为子女选择“第三姓”的权利。其理由是：到了一定的历史时期，古今中外的立法或习惯均要求姓氏世代相传；姓氏也可以用来区分血缘关系；姓“第三姓”不一定避免重名；姓联姓方是解决纠纷的良策；对生僻姓、歧义姓、贬义姓予以特殊处理即可。现行《婚姻法》第22条应修改为：父母可以给子女提供父姓、母姓、联（双）姓。

Rethink the Rights for Legitimate Children to Acquire the Third Surname

when parents choose the surname for their children,they should not have the right to choose the third surname.The reasons include the following,Legislation or practice in the old time and modern time,or in the foreign country and in china,requires children assume the father's surname or mother's surname;surname may be used to distinguish kindred;assume the third surname not necessary to avoid the surname name;double Surname is the best policy to solve the dispute;special policy may be used to rare surname,or the diverent surname and demening surname.Article 22 of Marriage Law in practice should be amended to the following, parents may give the children the father's surname or mother's surname and the double surname.
