| 摘 要： | 刑事扣押是刑事诉讼活动中一种十分重要的强制性措施，它对于收集和保全证据，保证诉讼活动顺利进行，尽量减少国家和被害人所受的经济损失有着十分重要的作用。然而由于我国刑事扣押制度的不成熟，不完善，加上司法实践中，长期受重实体、轻程序思想的影响，导致刑事扣押在执行过程中出现了诸多问题，应该采取措施予以完善。
