| 摘 要： | 随着世界范围内犯罪浪潮的增长和人们对犯罪问题的日益关注，各国学者都在运用不同的理论从不同的角度对各类犯罪进行解析，逐步深化对犯罪问题的认识，以期找到控制犯罪的良策。应从寻租理论出发，探讨和分析市场经济条件下法定犯罪中的设租和寻租现象及其形成原因，从刑事立法和司法的角度提出减少设租，实行非犯罪化，以实现刑法效益最大化的犯罪控制对策。

| Abstract: | Along with the worldwide scale in the crime tide growth and the people＇ attention to the crime question, the various countries＇ scholars utilize different theories to analyze from the different angles to each kind of crime, deepen gradually the understand- ing of the crime questions so as to find a brilliant plan of control crime. From ＂the theory of seeking rent＂, this article discusses and an- alyzes under the market economy condition the legal crime to suppose rents and seek rents and the reason of the crime. And from the criminal legislation and the judicial angle proposes the reduction of supposes rents in order to realize the maximization of criminal law benefit. |
