试论预防和打击黑社会性质犯罪的立法对策

虽然我国刑法仅规定了黑社会性质组织犯罪,但性质决定实质,故而刑法实际上已肯定了我国存在黑社会犯罪现象。随着国际黑社会组织向我国的不断渗透以及国内涉黑势力的自身演变,我国存在黑社会犯罪应是不争的事实,而且呈不断蔓延趋势。为此,应从法律层面加强对策研究,建立专门的反黑法律体系,完善刑事实体法、程序法和相关配套法律的规定,从而防疏堵漏,严密法网,以有效地防范和打击黑社会犯罪,遏制和减少黑社会犯罪的发生。

Considerations on the Legislation Countermeasures about Preventing and Hitting the Crime of Underworld

The criminal law of China regulated the organization crime with the underworld character only, but the character determines the spirit. Therefore, the criminal law ratifies the phenomenon of the crime of underworld in China in nature. Under the condition of the penetration of foreign crime of underworld and the self-evolvement of the internal underworld forces, that there exists the crime of underworld in China and in spreading situation is an unchallengeable fact. So we should emphasize the countermeasures research on the legislation level, erect the special anti-underworld law system, perfect the criminal substantive law, adjective law and relevant supporting law, in order to prevent and hit the crime of underworld, restrain and reduce its occurrence.
