民事诉讼中“新职权主义”的动向分析

针对我国民事司法实践中出现的限制当事人诉权和诉讼权利、回避审判责任的现象,文章称之为“新职权主义”,并就其表现的与传统职权主义的不同特征、对中国司法及诉讼制度乃至宪政制度的影响及其理论依据作了阐述。
