论我国国家所有权的性质——以所有权观念的二元化区分为视角

近代以来，私人所有权的地位虽然十分重要，但它不是所有权的唯一形态。公共所有权起源于罗马法，它与私人所有权在对立中并存，从而形成了所有权观念的二元化。两类所有权界限的清晰，是各自独立存在并分别满足人类生活私人性和公共性需求的前提。当代中国的国家所有权是公共所有权中的一种，因此才具备自己的特征，我们不能以私人所有权的逻辑来否定国家所有权的性质。国家所有权并非公共权力。只有形成对国家所有权民法性质的确信，才能适用民法保护国家所有权。
