| 摘 要： | 立法层面对"道德"的吸收不仅是有条件的,而且是受限制的,主要受制于承认理论的检验。道德因素在法律适用中的作用应且仅应作为法解释的考量因素。解决侵权行为的危机有两种路径,即内在创新或外在创新。但无论那种危机解决模式都需道德的勃兴。

| Abstract: | During the legislative course the moral element is considered about not only condition but also restriction.The consideration is examined by theory of recognition.The effection of moral elements is considered as interpretation eldments during the course of application of the law.There are two methods of resolution about moral ctisis of tort law,inherent innovation or external improvement. No matter what mode of crisis settlement the vigorous growth of moral is essential condition. |
