| 摘 要： | 战时民船征用个人利益法律保护是为了提高公民参与和支持战时物资保障的积极性。在我国以保障国家公权利的行使、较少考虑个人利益的法律文化背景下,以物权法的视角,提出若干战时民船征用个人利益保护的立法建议是法制社会的必然要求。征用必须合宪、合法,征用程序必须正当,征用必须补偿。只有这样,才能提高征用效率。

| Abstract: | Our country always pay more attention to safeguarding citizens＇ rights than ensuring personal interests.Under the legal cultural background,we are expected to strengthen the legal protection of citizens＇ personal interests from the protecting private property perspective.In order to balance the public rights and the private right,and improve the citizens＇ participation and support for military action,it is supposed to emphasize the constitutionality and legality of the employment,ensure its compensatory,and make clear its proper procedure,its coercion in emergency and its consultation in peace time. |
