| 摘 要： | 当代宪法和宪政发展的一大世界趋势，就是建立、健全、创制具有活力和效率的违宪审查制度。文章在中国现行的违宪审查制度的建构中，有其理论上的合理性和必然性，但构成其制的内在机理以及其运作的效力等方面，需要在世界性的大背景下加以审视，并在此基础上，提出健全中国违宪审查制度的构想。

| Abstract: | Constructing and completing a lively and efficient unconstitutional review system is the latest trend.The current construction of Chinese unconstitutional review system is necessary and reasonable theoretically,but still need survey on its mechanism and effect from worldwide angle of view,from which the system can be perfected. |
