The PRC-Laos BIT is Applicable to the Macau SAR?

Abstract:	On29September2016,theCourtoftheAppealoftheRepublicofSingaporeissuedthejudgmentconcerningSanumInvestmentLimitedv.TheGovernmentoftheLaoPeople’sDemocraticRepublic.Inthisjudgment,theCourtdeclaredthatthePRC-LaosBITwasapplicabletoMacauSAR.However,thejudgmentmadebytheCourtiswrongandthustriggeredaseriesofridiculousconclusionsbecauseofthewrongfulinterpretationonArticle31ofthe1969ViennaConventionontheLawofTreaties,thewrongfulidentificationonthenatureofthecustomsinternationalruleforthe“movingtreatyfrontier”rule,andtheinappropriatestandardofproofontheissueof“otherwiseestablished”.
