关于在我国《刑法》中增设袭警罪的法律探析

近年来,暴力袭警案件频发,目前我国对袭警犯罪刑事立法的滞后已经成为滋长社会不法势力和不法分子嚣张气焰的重要根源。袭警这一危害国家安全、挑战国家公权力的行为,不仅是对警察生命的威胁,对司法资源的破坏,更会严重危及人民群众的公共安全感。在我国《刑法》增设袭警罪可以保护警察执法权威和权益,从而更好地保护公民权。

On the legal analysis of adding the new crime of assaulting police into Chinese "Criminal Law"

In recent years,cases of violently assaulting police have more and more frequently happened.The backwardness of China's current criminal legislation of assaulting police has become a major source of social forces and illegal criminals' arrogance.Assaulting police is a kind of act endangering national security and challenging the national power.It is not only a threat to the lives of the police,but also damage to the judicial resources and it will seriously weaken people's public sense of security.The author believes that adding of the new crime assaulting police into Chinese "Criminal Law" can protect the rights and interests of the police authority and better protect civil rights.
