依法完善土地承包经营权制度

土地承包经营权制度是农村土地制度的核心,关系到农村改革发展稳定的大局。而我国现行土地承包经营权制度存在法律关系模糊、经营权流转难、相关规定没有彰显其物权属性等诸多缺陷,为此,应明确界定土地承包经营权法律关系的主体,放松对经营权流转的限制,进一步完善土地承包经营权公示制度和物权救济制度。

Improving Contractual Right of Land According to Law

Contractual right of land is the core of rural land system, which concerns the steady reform and development in villages. While, the present contractual right of land has many defects, which are the legal relation is dim, right of management cannot flow fluently, and related rules cannot manifest property of right. As a result, we should make the subject of contractual right of land clear, relax the flow of right of management and improve the publicity system of contractual right of land and relief system of property of right.
