论我国民事诉讼法典总则构造之完善

在"总则—分则"的法典结构方式下,总则在法典的体系化、彰显法典的精神和缩减法典篇幅等方面具有重要意义。总则所具有的功能和优点是通过总则本身的构造来实现的,总则的构造是在法典化过程中立法者首先遇到的问题,只有内容完整、结构严谨的总则才能最大限度地促进法典的完善。比较和借鉴德国、法国、日本、俄罗斯和我国台湾、澳门地区的民事诉讼法典的总则之构造以及民法典的立法技术,博采众长,以完善我国民事诉讼法总则的内容和结构,具有重要的立法论意义。

On Improving Construction of General Rules in Civil Procedural Code

In a code embodying general section and branch section,general rules plays important roles in systematizing the code,sharply showing the spirit of the law,reducing the length of the code.Construction of general rules,through which the functions and advantages of general rules are realized,is the first question confronting legislators in the process of legislation.On the basis of comparative research into the general sections in the civil procedural codes of German,Japanese,Russian,French,Hong Kong and Macao of China,a tentative design of content and structure is presented to improve the general rules of our civil procedural code.
