| 摘 要： | 《中华人民共和国合同法》规定的建设工程承包人优先受偿权,充分体现了法律对特殊债权予以特殊保护的精神,但如何正确认识并理解承包人的优先受偿权,并在司法实践中正确应用,具有十分重要的现实意义。应该对承包人优先受偿权制度进行系统论证,使这一制度更有效地服务于房地产开发建设。
