论食品安全犯罪移送侦查立案程序的完善

中国人一直把食物视为崇高的＂天＂一样尊敬和重视,＂食物＂或者说是＂温饱问题＂在我们的历史进程中又起着载舟覆舟的重要作用,打击食品安全犯罪势在必行。由于食品生产销售的特殊性,食品安全犯罪的立案侦查多始于行政机关移送,而立案又被称为刑事诉讼的关口,是刑事诉讼活动开始的标志。要从根本上治理食品安全犯罪,必须明确食品安全行政执法程序与刑事侦查程序间的关系;将刑事程序优先原则落到实处;统一取证程序,提高立案侦查效率;完善立案监督程序,建立信息化网络平台。

A Discussion of the Filing Procedure of Criminal Investigation on Food Safety Crime to Resolve the Subsistence Problem

Food safety has remained an issue of common concern in the recent years.It is necessary to crack down on food safety crime.The filing of charges against such crimes usually starts from the handover of the case from administrative bodies to procuratorial ones.It is a crucial step toward and symbol of criminal proceedings.To curb food safety crime,the relationship between administrative law enforcement and criminal investigation procedure must be clearly defined and the latter be prioritized;evidence collection should be synchronized,and efficiency raised,supervision over filing improved,and internet-based platform established.
