跨法犯刑法适用若干问题研究

我国刑法为适应社会的发展而处于不断地修正和完善之中,新旧法条的变化和某些犯罪过程的交织,是跨法犯产生的基本成因。由罪刑法定原则所主导的刑法溯及力原则与刑法对某些具体犯罪形态的处理规定之间存在着难以协调的矛盾,必须通过理论探索和诠释来解决刑事立法中存在的突出问题。本文的撰写旨在于推进刑事立法的周全和完善,主要从一犯罪行为、数犯罪行为以及共同犯罪行为跨新旧刑法所产生的一系列问题入手进行探索和研究。
