职务犯罪中自首有关问题研究

在查处职务犯罪中,自首对于鼓励犯罪人主动归案、争取宽大处理、降低司法成本、提高破案率都具有十分重要的作用。在对自首制度研究的基础上,结合最新司法解释,对"两规"期间自首、准自首的认定,如实坦白的司法处理,赃款赃物追缴对自首认定的影响以及单位自首的认定问题等进行探讨,有利于推动相关研究的深入及对查处职务犯罪的实际工作有所帮助。

Study on the Problems of Self-Confession to Judicial Departments in Dealing with Post-Related Crimes

In dealing with post-related crimes,self-confession is positively significant,which encourages offenders to turn in themselves to police for lenient punishment,reduces judicial costs and raises clearance rate.Based on the research into the self-confession mechanism,and with reference to the new law interpretation,this paper probes into the problems of confession during incarceration,voluntary confession,thorough confession,the effect of confiscation of loots on determination of confession and work units＇determination of confession and so on so as to help promote further research into handling post-related crimes.
