| 摘 要： | ＂罗马法＂本是罗马王国、罗马共和国和罗马帝国各时期法律的总称,但后世法学家却往往习惯于将《民法大全》当作罗马法的全部。《民法大全》于公元6世纪在君士坦丁堡成书时,西罗马帝国已然落入蛮族之手,《民法大全》在施行了数年后,亦被遗弃,直到11世纪才重见天日。在罗马,存在着远比《民法大全》更古老的法律。为了避免将罗马法＂平面化＂,诚有将罗马法相关文本的研究置于其成书的特定时空,即在特定的历史氛围和地域场景中加以研究的必要。

| Abstract: | Roman laws are general terms for historic periods of Roman Kingdom, Roman Republic and Roman Empire, while scholars used to consider the Corpus Juris Civilis as the whole of Roman laws. Completed at Constantinople in 6 AD when the Western Roman Empire had already been conquered by barbarians, the Corpus Juris Civilis had been repealed for several years till 11 AD. Therefore, those ancient laws prior to the Corpus Juris Civilis have been neglected by scholars. It is essentially necessary to study the texts of Roman laws in their respective time and space sphere so as to avoid the "complanation" of Roman laws. |
