| 摘 要： | 现行的民事原告资格的立法模式，从法律制度设计上排除了公益诉讼存在的可能性，民事公益诉讼中的原告除直接受到公益违法行为侵害的个人或组织以外，还可以是非直接受到侵害的个人、相关社会团体和人民检察院。
