| 摘 要： | 作为婚姻法的调整对象——婚姻,其本质对于构筑整个婚姻立法具有重要意义。将婚姻定性为契约更符合婚姻的本质,我国婚姻立法应以民事契约理论为基础,以充分体现婚姻自由原则与男女平等原则,实现婚姻法的功能。
