我国现行司法救助制度的缺陷及完善

我国现行司法救助制度存在的缺陷主要表现在:申请救助的主体采用列举式的立法模式;申请救助的条件未规定统一的认定标准;缺少审查决定程序的规定。要从立法上完善司法救助制度须从法理基础入手,明确其存在的意义和功能,并在此基础上设计一项较为完备的司法救助制度应有的程序。

Defects and Improvement of Current Judicial Relief System in Our Country

The current judicial relief system in our country is confronted with the following defects: the main body suitable for applying for judicial relief is limited by legislation; standard of the said main body's conditions has not been stipulated generally; it lacks the regulations for examination and approval procedure. So, the ways to improve this system should be started with the legal principle, define the significance and function of it. Baing on the above-mentioned steps, it is realizable to design a set of fairly complete procedure of judicial relief system.
