| 摘 要： | 刑法修正案（八）对盗窃罪做了较大的改动,“入户盗窃”就是其中一种新增的行为类型,这使得原有法益保护产生了新的变化,需要从法益保护角度对“入户盗窃”中的“户”进行定性,并对这种新的入罪行为进行分析及确定“入户盗窃’’既遂与未遂的区分标准。

| Abstract: | Amendment Ⅷ to the Criminal Law makes several notable alterations to larceny.Indoor Theft is included as a new type of crime,adding changes to the original law benefit protection.We need to ascertain the nature of Indoor as in Indoor Theft from the angle of law benefit protection,analyze this new criminal act and establish a standard about to distinguish the accomplished crime and the attempted offense in the issue of Indoor Theft. |
