司法改革中的民事检察监督制度与法治理想——以法治的社会基础为视角

随着《民事诉讼法》的修改,民事检察监督制度在立法层面得到了细化,体现了司法改革的阶段性成果。但理论上对该制度仍存在着误读,其根源在于:一是没有将该制度放在我国法治的社会基础上进行考量,过分强调了民事审判制度的独立性;二是忽略了民事检察监督制度的纠纷解决价值;三是将法官的权威与司法权威画等号。为了实现法治理想,应当在中国社会的法治基础这个视角下来审视我国的民事检察监督权的发展及完善。

Rule-of-Law Ideal and System of Procuratorial Supervision over Civil Lawsuits in Judicial Reform：From Perspective of Social Basis of Rule of Law

With the amendment to Civil Litigation Law,the system of procuratorial supervision over civil lawsuits is detailed on the legislative level,reflecting the current stage of achievements in judicial reform.However,there still exist linguistic imperfections in theory concerning the system,with the following three root causes：the system is considered with no reference to China＇s social basis of rule of law and with over-emphasis ofindependence of civil litigation system,dispute resolution value of the system of procuratorial supervision over civil lawsuits is neglected,and the judge＇s authority is regarded the same as judicial power.To realize rule-of-law ideal,we should examine the development and improvement of China＇s procuratorial supervision over civil lawsuits from the perspective of China＇s social basis of rule of law.
